TERMS AND CONDITIONS

The company responsible for the selection process is Rare-TV, 20 Bakers Row, Farringdon, EC1R 3DG.

1. ELIGIBILITY

1.1. To be eligible to take part in this Project, you must be (a) aged at least 18 (eighteen) years of age, (b) a United States citizen, Canadian citizen, European Union citizen or Australian citizen.

2. DATA PROTECTION

2.1. By necessity we will process your personal data as part of developing and producing the Programme. To the processing of your personal data for the purpose of considering your application, for administration, production and exploitation of the Programme and for related services, in accordance with the Data Protection Act 1998, EU GDPR and other applicable data protection legislation and the provisions of this application form. We will do so in accordance with all relevant data protection law and you can find out more information about how we process your personal data by visiting https://www.rare-tv.com/privacy or contacting Rare-TV for a copy of the relevant Privacy Notice by email to privacy@rare-tv.com.

3. GENERAL

3.1 These terms and conditions relate to your application to take part in the Programme and form part of your Application Form.

3.2 Unless stated otherwise, you are responsible for all costs associated with your application and any attendance at Programme related events.

3.3 We are not able to acknowledge all applications and shall not be responsible for any fault and/or failure of your application getting to us on time.

3.4 You accept that we shall have absolute discretion to determine who appears in the Programme. We shall have the right to stand you down at any time and you shall not have any right to appeal against our decision, which shall be final.

3.5 Regardless of whether you participate in the Programme, we shall not be under any obligation to produce, exhibit and/or exploit the Programme.

3.6 We may, at our sole discretion, amend these terms and conditions and/or amend the closing date for applications at any time and shall use reasonable endeavours to notify you of any such relevant amendments via email or otherwise.

4. YOUR OBLIGATIONS

4.1 You are not aware of any physical or mental reasons (including without limitation phobias, allergies, heart disease, epilepsy, high blood pressure, back complaints or any recent illness, operation or course of treatment) which would, or be likely to, endanger your health or the health of others during your participation in the Programme.

4.2 You agree to complete the Application Form and any other document(s) required for the Programme, accurately and honestly.

4.3 You confirm that there is nothing restricting you from participating in the Programme and agree to immediately notify us if this changes.

4.4 You agree to treat as confidential and not disclose to any third party any information about this casting process and/or about the Programme that we disclose to you. This provision does not apply to any information about the Programme that is in the public domain or which is authorised to be disclosed by law.

4.5 Without limiting the generality of the provisions of our Prospective Contributor Privacy Notice (found at https://www.rare-tv.com/privacy) you agree that we may conduct appropriate background checks on you and that we may obtain information about you from appropriate third party sources and agencies.

4.6 You agree that if we confirm that we would like you to participate in the Programme, you agree to complete and/or enter into such further document(s) and/or agreement(s) as we may reasonably require for your participation in the Programme.

5. INTELLECTUAL PROPERTY RIGHTS

5.1. In the event that you are invited to attend an audition and any other subsequent stages of the Programme selection process, you agree and consent to the filming and recording of you and your voice, conversation and sounds, including any performance of any musical composition(s), during and in connection with your application for the Programme (the “Contribution”) and to the use of your Contribution in whole or in part or not at all in the Programme and/or in connection with the Programme and you agree to participate in advertising, promotion, marketing and publicity for the Programme.

5.2. You irrevocably grant and assign to us by way of present assignment of present and future copyright, all rights of any nature in and to the rights, title and interest in your Contribution to enable the fullest use throughout the world of the Contribution or any part(s) thereof by all means and in all media in connection with the Programme or otherwise in perpetuity. You accept that we have the right to edit, copy, adapt or translate the Contribution as we require.

5.3. You further agree that any photographic material(s), video material(s) and/or any other materials you submit as part of your application to appear in the Programme and/or as part of your Contribution (collectively referred to as the “Material”) may be featured in the Programme and you warrant that you have the necessary licences, rights, consents and permissions to authorise us to use the same in full or in part.

5.4. You grant us a worldwide, perpetual, royalty free and transferable licence (with the right to sub-licence) to use, edit, record, modify, translate, distribute, make available to others, prepare derivative works of and exploit the Material by any medium or method whether now known or later developed throughout the world for the full term of copyright and other rights and all renewable and extension thereof. You agree to provide us with details of all such licences, rights, consents and permissions relating to the Material if we so request.

5.5. For the avoidance of doubt, you agree that we have no obligation whatsoever to return any materials (including without limitation, the Material) which you have submitted as part of your application form whether or not you are selected as a participant and that we are in no way obligated to use any such materials in connection with the Programme.

5.6. You grant us the right to use your name, voice, likeness, photographs and any biographical material concerning you and any Contribution or Material in connection with the promotion and exploitation of the Programme and/or ancillary products/services and/or in connection with us and/or the broadcaster, exhibitor and/or distributor of the Programme, throughout the world in all media in perpetuity.

5.7. You irrevocably waive the benefits of and agree not to assert any provision of law known as 'moral rights'; or any similar laws of any jurisdiction in respect of any Contribution and/or Disclosures.

6. MISCELLANEOUS

6.1. Should there be a dispute regarding your participation in the Programme, our decision on this dispute shall be final.

6.2. You agree that we may freely assign or license your Application Form (including the Terms and Conditions).

6.3. Your Application Form and any non-contractual obligations arising out of or in connection with it or its subject matter, shall be governed by, and construed in accordance with, the laws of England and Wales and each party irrevocably submits to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim that arises out of or in connection with your Application Form or its subject matter.

6.4. Disclosure of criminal convictions, current or pending criminal proceedings and/or county court judgments at any stage of the application process will not automatically exclude you from participating but we shall be entitled to exercise our sole discretion in this regard and certain convictions (spent or otherwise), pending criminal proceedings and/or investigations may invalidate your application or otherwise result in the termination of your application and/or your continued participation in the Programme. In all cases our decision shall be final.

6.5. You must notify us immediately if (i) you are convicted of a criminal offence; (ii) criminal charges are brought against you; and/or (iii) you are subject to a criminal investigation after you have submitted this application form but before filming, and first transmission of the episode of the Programme you appear in (if any).
